Principles of Critical Morality for the Critique and Reform of Public Morality: A Case Study Analysis of Four Moral Cases in the Jurisprudence of the European Court of Human Rights

Abstract
Recent developments in the jurisprudence of the European Court of Human Rights indicate a gradual shift from classical public morality, grounded in socially accepted norms, toward a critical morality based on normative evaluation. This transformation has influenced the Court’s approach to balancing public interests and fundamental rights. This study aims to conceptualize and systematically articulate the role of critical morality in judicial practice through a qualitative, analytical–interpretive examination of selected landmark judgments of the Court. By analyzing the normative structure of judicial reasoning, the research identifies underlying moral principles embedded in the Court’s case law. The findings reveal a movement from morality understood as social consensus toward a framework centered on human dignity, individual autonomy, and critical reflection. The study proposes a coherent conceptual model of “critical morality in judicial practice,” clarifying the evolving relationship between public morality and the interpretation of human rights within the European human rights system.

تحولات اخیر در تفسیر حقوق بشر نشان‌دهندة حساسیت و تغییر رویکرد دادگاه‌های ملی و بین‌المللی به مسئلة حقوق اساسی بشر است. یکی از مهم‌ترین چالش‌ها در فلسفة حقوق معاصر، تعارض منافع و حقوق جمعی در برابر منافع و حقوق فردی بوده است. دادگاه اروپایی حقوق بشر به‌عنوان یکی از اولین و موفق‌ترین دادگاه‌های فراملی با هدف محافظت از حقوق اساسی افراد در برابر دولت‌هایشان، پرونده‌های جنجالی بسیاری در این حوزه تشکیل داده است. آرای صادره توسط قضات این دادگاه، علی‌رغم احترام به اخلاق عمومی، نشان‌دهندة تلاش جهت نقد و اصلاح مفهوم اخلاق عمومی توسط اخلاق انتقادی است. پژوهش حاضر با هدف تبیین و صورت‌بندی مفهومی «اخلاق انتقادی در عمل قضائی»، اصول اخلاق انتقادی نهفته در رویۀ قضائی دادگاه، مانند اصل کرامت ذاتی انسان و اصل جهان‌شمولی را استخراج و تحلیل کرده است. این تحقیق از حیث هدف، بنیادی و از نظر رویکرد، کیفی است و با اتکا بر روش تحلیلی ـ تفسیری در چارچوب مطالعات میان‌رشته‌ای فلسفۀ اخلاق و حقوق بشر انجام شده است. داده‌های پژوهش از طریق مطالعۀ اسناد حقوقی و گزینش هدفمند پرونده‌های شاخص دادگاه فراهم آمده و با تحلیل مفهومی و مقایسة درون‌رویه‌ای بررسی شده‌اند. یافته‌ها نشان می‌دهد که در رویۀ قضائی دادگاه، گذار تدریجی از اخلاق عمومی کلاسیک،که صرفاً مبتنی بر پذیرش اجتماعی بودند (هنجارهای برساختة اجتماع)، به اخلاق مبتنی بر عقلانیت انتقادی (هنجارهای اخلاقی معتبر) قابل شناسایی است؛ الگویی که در آن بازتعریف نسبت میان منافع عمومی و حقوق بنیادین فردی نقش محوری دارد. نوآوری پژوهش در استخراج نظام‌مند اصول اخلاق انتقادی از متن آرای قضائی و ارائۀ چارچوبی مفهومی برای فهم تحولات آیندۀ تفسیر حقوق بشر تبلور می‌یابد.
